Florida’s Strict POA Rules
Florida law has specific requirements that surprise many first-timers. Florida does not recognize “springing” powers of attorney that take effect only upon future incapacity; a Florida durable POA is effective when signed. The document must be signed before two witnesses and a notary. Certain powerful authorities, such as making gifts or changing beneficiary designations, must be specifically initialed by you. A vague or improperly executed POA can be rejected by banks.
Health Care Surrogate Designation
A health care surrogate designation (Chapter 765) names a person to make medical decisions for you if you cannot make them yourself. For young couples, this typically means naming your spouse, and a backup. Florida allows you to give your surrogate authority to act immediately, which can help avoid delays in a crisis.
The Living Will
A living will is your written statement about end-of-life care, such as whether you want life-prolonging procedures if you have a terminal condition. It relieves your family of guessing your wishes during the hardest moments. Many Miami families pair the living will with the surrogate designation so both decision-making authority and instructions are in place.
